These Terms of Use are a legal agreement between you and Vue Consulting Pty Ltd (Vue Consulting). By enrolling in a Vue Consulting Online Edition you are accepting these terms. If you do not accept these terms, do not complete or pay for the enrollment process. This agreement applies to all materials located at our online learning portal (vueconsulting.tribalhabits.com).

Access

We will endeavour to allow uninterrupted access to your online learning material, but access to the topics may be suspended, restricted or terminated at any time. We reserve the right to change, modify, substitute or remove without notice any information in the material from time to time. You will have access to the courses you have purchased for a 12 month period from the date of purchase.

Intellectual Property

The copyright in the material contained in the topics, together with the design, text and graphics and all software compilation belong to Vue Consulting. All rights are reserved. None of this material may be reproduced or redistributed without Vue Consulting’s written permission. If you download any topic materials from our site, all the material and data are deemed to be licensed to you by Vue Consulting, for your personal, non-commercial use only. Vue Consulting does not transfer either the title or the intellectual property rights of the topics and Vue Consulting retains full and complete title to the topics as well as all the intellectual property rights therein. You may not sell, redistribute or reproduce or convert any of the material. Vue Consulting owns all trademarks and logos and you may not copy or use them in any manner.  Nothing contained in these Terms confers upon either party any rights to any trademark or any intellectual or industrial property of whatever nature belonging to the other party.  Vue Consulting may use or amalgamate any survey results acquired in the process of this assignment in its own learning, marketing or promotional materials but only on a generic and anonymous basis.

Exclusions of Liability

Vue Consulting will use reasonable endeavours to ensure that the data in the topics is accurate and to correct any errors or omissions as soon as practicable after being notified of them. To the extent permitted by applicable law, we disclaim all warranties and representations (whether express or implied) as to the accuracy of any information contained in the topics. We do not guarantee that the material will be fault free and do not accept liability for any errors or omissions.  We do not give any warranty that the website is free from viruses or anything else, which may have a harmful effect on any technology. Vue Consulting makes no representation whatsoever regarding the content of any other websites, which you may access from the topics. A link to a non-Vue Consulting website does not mean that Vue Consulting endorses or accepts any responsibility for the content or use of such websites.

Cancellations/Refunds

Topics purchased cannot be cancelled. Enrollment fees paid for topics are not refundable after your have logged in and explored any topic unless special circumstances apply.  If you have purchased and wish to transfer your enrollment to other participant, you must do this before you begin exploring any topics. This agreement, and the availability of complaints and appeals processes, does not remove your rights to take action under Australia’s consumer protection laws.

Acceptable Use

Your access to the topics is subject to our acceptable use policy. You must comply with the following…

  • You must not upload or use content that us threatening, defamatory, offensive, or which could expose you or us to liability for breach of criminal or civil law or any regulatory obligation;
  • You must not infringe anyone’s intellectual property rights or information privacy rights in the course of using the topics. This means you must ensure you have the right to use any material or content you upload or use in relation to the topics;
  • You must not use the topics for the purpose of commercial advertising or promotion, including the publication of unsolicited commercial messages (“spam”);
  • You have a discretion as to what data you submit and use with the topics and what information you provide and exchange. You acknowledge that we have no responsibility for the content of data provided by you and your users.

We may at our discretion edit or remove data or information, issue a warning, or suspend or terminate your enrollment immediately, in response to any breach of this agreement or our acceptable use policy.  We may refer use, data or information which in our view may breach Australian criminal law to a relevant law-enforcement authority. We may update our acceptable use policy from time to time. Updates are effective on and from publication of the updated policy on our website.  You acknowledge that you are responsible for all use of the topics by you. We are entitled to assume that use through your account is use by you.  You indemnify us and our related companies, officers and employees and keep them indemnified from and against any claim, demand, suit or liability arising from any use of the topics through your account.

Passwords

You will use your provided email address to access your topics. You will be required to set a password upon your first login. Your login details are the methods used by us to identify you and so are very important. You are responsible for any payments due for services accessed through the website by anyone using your password details. Any information regarding someone using your password details should be advised to Vue Consulting immediately. For clarity, you cannot share your login and password details with anyone else. Your enrollment is strictly for your use-only and cannot be shared with any other participants. Our servers monitor access and we reserve the right to suspect your login if we suspect it is being shared until we can investigate with you.

General

We may modify these terms and conditions at any time by publishing the modified terms and conditions on the website.
